Financial, healthcare and end-of-life decisions are critical topics for all family caregivers and care recipients to consider, but most especially for LGBT family caregivers and their loved ones.   Knowledge about available legal protections, the state-controlled limitations and how to avoid potential pitfalls is essential for aging network professionals who work with the LGBT community to ensure that they are on secure legal footing before the need arises. 

Participants in this web seminar will:

  • Examine real-life examples that demonstrate what might happen to LGBT couples if advance directives are not in place prior to need
  • Receive statistics on LGBT caregiving, how the traditional supports in place for caregivers might be lacking for LGBT caregivers and potential difficulties involved in serving the diverse LGBT population;
  • Understand advance directives for health care and the differences between living wills, DPAHs and DNRs and how these interact with HIPAA rules and the federal legal status of same-sex couples, and learn how to encourage LGBT clients to think proactively to ensure these documents are properly prepared

Presenters:

Tom Sciacca is a Trusts & Estates attorney and litigator based in Manhattan.  In addition, he has served as a volunteer attorney with the SAGE legal clinic since 2004, addressing the legal needs of the older LGBT adult community.  He is also an Adjunct Professor at New York University.
Nancy J. Knauer is the I. Herman Stern Professor of Law. She has written extensively on the topic on LGBT aging.  Her most recent book, Gay and Lesbian Elders: Law, History, and Identity Politics in the US, focuses on the unique challenges facing older gay men and lesbians
